Absa bank in Kenya, has been dragged to court by a businessman over alleged leak of his private information to third parties without his approval.
Kirui Kamwibua, who’s the owner of New mega Africa Ltd is currently is demanding damages of Ksh192 million as loss of income, Ksh1.
He has also requested for 2 billion for loss of goodwill, and requested Ksh92 million for the loss of fixed assets in the suit presented before Mombasa Commercial Bank Admiralty court.
He has also said that his confidential data was made public by a worker of the bank thereby causing reputational damage to his business operations.
He said; “As a result of the leakage, the plaintiff’s creditors and other suppliers descended upon him and interrupted the business operations.”
The businessperson also claimed that the action of the bank staffer to make open his confidential information to third parties and refusal to uphold sense of secrecy of his bank accounts by publicizing his financial statements with outsiders, violated his right to privacy and constituted a breach of its common law of fiduciary duty.
He also added that efforts to protect his transport business by demanding the financial institution to rebuild its obligations of loan were not approved and led to financial sabotage.
