Gov Adeleke beats predecessor Oyetola at Appeal Court
The Court of Appeal in Abuja, on Friday, March 24, 2023 confirmed the victory of Osun State Governor, Senator Ademola Adeleke.
The Court quashed the position of the Election Petition Tribunal, which had earlier ruled in favour of the immediate past Governor of the state, Adegboyega Oyetola of the All Progressives Congress, APC.
The Informant247 recalls that the tribunal on January 27, 2023 declared Oyetola the winner of the state governorship election which took place on July 16, 2022.
The three-man panel revealed that the appellant did not forge any documents and that the report of the server of the electoral commission which earlier upheld the victory of Oyetola was not applicable.
The appellate court upheld that the BVAS is the key and primary source of election accreditation.
The court of appeal therefore disregard the judgement of the election petition tribunal, and affirm the victory of the sitting Governor of the state, Ademola Adeleke.
The Informant247 earlier reported that the Court of Appeal Court has reserved judgement in the appeal by the incumbent Governor of Osun State, Senator Ademola Adeleke which challenges the state’s governorship election.
After receiving arguments from both lawyers of the Governor, Adeleke and lawyers of the former Governor, Gboyega Oyetola, the panel on Monday, March 13, 2023 reserved judgment in the appeal.
The Informant247 recalls that the incumbent Governor on February 9, 2023 appealed the judgment of the Osun State Governorship Election Petitions Tribunal.
The judgement of the tribunal favoured the immediate past Governor of the state, Oyetola, as tribunal nullified the election.
2 out of the 3 member panel of the tribunal maintained that the former Governor proved beyond a reasonable doubt that there was overvoting in some of the polling units.
