Woman drags neighbour to Kaduna court over alleged trespass

Saratu Adam, a business woman, on Tuesday took her neighbour, Garba Aminu to a Sharia Court, in Magajin Gari, Kaduna, over alleged trespass.

She dragged Aminu to court for allegedly encroaching and building on her land.

Abdulbasit Sulaiman, who’s Adam’s Counsel, informed the court that Adam and Aminu had purchased one plot of land, measuring 50/50 each in Tudun Wada area of Kaduna.

Sulaiman also made an allegation that when Aminu made a building on his plot, he encroached into the plot of his client without her approval.

Sulaiman implored the court to ascertain whether Aminu’s act was not in contravention of Adam’s rights to her plot as required in Section 174 of the Sharia laws.

The defendant, Aminu ‘s counsel, Sulaiman Lere, said the court lacks the jurisdiction to welcome the case.

Besides, Lere made an allegation that the parties involved had reached an agreement over the matter.

Lere has said that Aminu had given Adam N200,000 over the encroachment and that the court has no powers to alter the agreement reached by the parties.

The Judge, Murtala Nasir, who’s presiding over the matter has said he would pay a visit to the scene to decide the dispute and adjourned the matter until December 12, for hearing.
