Latest reports coming in from Spain says the Barcelona Prosecutor’s Office has opposed the provisional release of Dani Alves as his defense requested last week.

This opposition to the release of the former Player was reportedly influenced by the concern of authorities who have considered the possibility that the Brazilian footballer may decide to flee in order to evade justice.

According to sources from the Public Prosecutor’s Office, the case’s prosecutor submitted a report to the 15th examining magistrate’s court in Barcelona.

The document, according to Marca establishes that the circumstances have not changed since January 20, when Alves entered prison.

Consequently, The investigating magistrate must now decide whether to grant the request of Alves’ defense and release him on bail, with the precautionary measures that are deemed appropriate

Meanwhile, the outcome may be disputed before the Barcelona Court of Appeals.

Alves’ Lawyers argue case

Alves’ lawyers last week requested that the judge release him on bail based on several security cameras images from the nightclub that would exonerate him.

They argued that the images would demonstrate that the accused and the victim were flirting before the alleged incident occurred and claimed that the sexual intercourse with the complainant was consensual and that he lied in his first statement to hide his infidelity to his wife.

The lawyers maintained that the pair were dancing and drinking together, and that the alleged victim voluntarily entered the bathroom after Alves did.

They also argued that the 200-page expert report, which analyzes the images frame by frame, denies the “microcosm of panic and terror” reported by the victim and points out that the twenty minutes they spent together before entering the bathroom “were typical of a sexual courtship”.

Earlier, the friends of the complainant explained to the judge that the footballer approached them with obvious sexual intent until they felt uncomfortable and Counsel to Alvez claimed that the images captured by the security cameras contradict the testimony of the two friends who accompanied the complainants.

Alvez on April 17 himself presented his request for release after testifying for the second time before the investigating magistrate.

It remains to be seen where the case is headed with the Brazilian defender now spending more than three months in prison
