Over the lingering crises ensuring between the Executives and Legislative arms of the National Association of Kwara State Students, the Judicial Council of the Association has called for peace between the two other waring parties.
The crises which was instigated by the Executives’ inconveniency over the Senate council’s protest held in support of the Senate President over his continuous trail at the code of conduct tribunal.
However both parties have been releasing statements and counter-statement to justify their acts.
In the meantime, the Judiciary arms of the Association has called on both parties to maintain peace or face the full wrath of the law as the arms is saddled with the responsibility of maintaining peace between both arms.
The statement released by the arm and signed by the Cheif Judge, Hon. Justice. Moshood Ibrahim, reads, “It is of great importance for the judiciary to come in at this level as the body empowered by the constitution of NAKSS,National Headquarter in Article 11, S. 2(1) that:”the council shall to the extent of any other body have jurisdiction over matters relating to settling dispute between the other arms of the association and affiliated chapter “.The attention of the general public is to be drawn to the fact that the judiciary as a body is an independent and unbiased umpire of justice which does not aligned itself to any arm of the union and that after contacting the relevant officers from the both arm for the sake of fair hearing,the judiciary has reached the following conclusion on the burning issue on ground:
– No power is absolute and even if the constitution gives an officer some power(s) it must be used judicially and judiciously. No officer/arm of the association is the Alpha and omega.
– No Arm of the Union is said to be “absolutely independent” and decisions should be made by the 3 arms whenever same is reasonably necessary or required most especially on issues of general interest/concern.
– The attention of the jury has been drawn to the purported rift between the executives and the legislative arm(which we believe it’s the Genesis of this hullabaloo) therefore they should try and settle same amicably between each other for the progress and success of this administration.”
Urging both parties to sheath their sword and maintain peace, the statement continues,
“- Henceforth, every officer should also abreast himself/herself with his/her constitutional rights and corresponding duties. We are equality urged to desist from encroaching into the duty(s)of others as this will amount to contravention of the constitutional provision and the culprit will face serious sanction from the judiciary.
– Most importantly, a “perpetual injunction” has now been put against the release of further press statement by any arm of the Association on this particular issue and the injunction shall take effect immediately after the release of this ruling. Any arm or officer of the Association who remain adamant will face the wrath of the law.”
