Esinrogunjo’s leaked audio: Legal corner

Lawyers have reacted to the leaked audio of a former Kwara Central senatorial aspirant, Musbau Esinrogunjo.

Esinrogunjo in the leaked audio, which has now went viral, alleged the Kwara state governor, AbdulRahman AbdulRazaq — and some party leaders — of several atrocities and further threatened to kill the governor.

Barely 24 hours after the audio was leaked, a videotape of Esinrogunjo denying threat to the governor’s life surfaced. In the videotape of about 6 minutes, he claimed the leaked audio was doctored.

This however caused public outcry which prompted the State Security Service (DSS) to invite the politician for interrogation.

In the meantime, THE INFORMANT247 reached out for legal views on the threat to life and allegations made by Esinrogunjo.

I’ve heard the voice record credited to a member of the party allegedly threatening the life of the executive Governor of Kwara State coupled with allegations of some civil wrongdoings against some leaders of the ruling APC in the state. I have also seen the video record, discarding some parts of the first voice record particularly as regards the alleged threat to the executive Governor’s life.

I learnt the suspect has been invited by the law enforcement agencies and he has honoured the invitation and has been given administrative bail in line with the law.

Since the matter is before the law enforcement agencies for investigation to know if there is a pri mafacie case against the suspect, which if established can lead to prosecution for a criminal offence, but if not, the suspect has to be freed. It is not more than that.

In my humble opinion, the outburst of comrade Esinrogunjo without prejudice to his constitutional rights of expression was to totally uncalled for, let forget that the person he purportedly attached is sitting Governor, even to ordinary person he doesn’t have the right to do such but that notwithstanding I would like to give the benefits of the doubt as to his utterance in viral audio of which I learnt he has denied involvement.

But legally speaking if at the outcome of investigation, DSS found comrade Esinrogunjo culpable, then he might be charged for the offences of threaten to life, inciting public disturbance and treason against the executive governor of Kwara State.

Threat to life is an offense in criminal justice system world all over. I listened to the audio tape credited to Comrade Musbau Esinrogunjo and I can conclude that there are ingredients of threat to life against the Governor.

To reach a just conclusion, I also watched the video tape credited to Comrade Esinrogunjo wherein the former denied that he was the one who indeed made the statement in that audio tape. Let me say this, both video and audio tape will be subjected to judicial scrutiny. But in my own humble view, the video aspect of it is more reliable, authentic and undeniable because he showed the face of the maker, Esinrogunjo.

Comrade Esinrogunjo having denied the fact that he threatened Governor AbdulRahman AbdulRazaq in that video which surfaced after the audio, I go with it. This is a question of fact and it depends on how you establish it in court. Don’t forget that this is an era of technology where everything can be doctored, where Esau head can be given to Jacob.
