Justice Mohammed Garba-led fiver-man Supreme Court on Friday, in a unanimous judgment, upheld the election of Peter Mbah as duly elected Enugu State Governor in the March 18 governorship election in the state while dismissing the appeal by the Labour Party and its candidate, Chijioke Edeoga, saying did not substantiate their allegations of non-compliance.
Mbah was the candidate of the Peoples Democratic Party in the election.
The Informant247 reports that the Court of Appeal, sitting in Lagos, had on November 10 upheld the judgment of the election petitions tribunal, which affirmed the Independent National Electoral Commission’s declaration that Mbah won the election.
The three-member panel, headed by Justice Tani Yusuf-Hassan, dismissed the three grounds of the appeal filed by the Labour Party and its candidate for failing to provide sufficient evidence to support their claims that the governor was not qualified to contest the election.
