The Kwara state chapter of the Nigeria Bar Association (NBA) has demanded the release of its member, Barrister Sulyman Toyin Yahaya by the Ilorin zonal office of the Economic and Financial Crimes Commission (EFCC), following the order by the Federal High Court sitting in Ilorin, Kwara State.
The Informant247 gathered that Barrister Sulyman Toyin Yahaya, who represented his client at Economic And Financial Crime Commission (EFCC), was detained by the commission.
Meanwhile, sequel to the development, the executive of the NBA Ilorin branch met with the Ilorin Zonal Head of the anti-graft agency, Michael Nzekwe to resolve the rancor but refused to give them audience.
NBA however, approached the Federal High Court in Ilorin for the Enforcement of the Fundamental Human Right of its member. An experte application was filed along with the originating Summons praying the court for the release of Applicant pending the determination of the substantive suit.
The Court found the application meritorious and magnanimously granted same and the Court Ordered the release of the Applicant unconditionally. The order of the court was duly served on the commission by the bailiff of the Court and the NBA Secretary, Mr. Taofeeq Olateju, but the Ilorin Zonal Head of EFCC, Mr. Micheal Nzekwe failed to obey the court order despite the service of same on him.
It was learned that as of 6.29pm yesterday 3/8/2023, the Applicant, Suleiman Toyin Yahaya Esq is still being kept by the ilorin office of the EFCC. Copies of the court order and affidavit of service of the order on EFCC are attached for ease of reference.
