Court sacks Abia Gov-elect, Alex Otti, nullifies candidature of all Labour Party candidates in Abia, Kano

A Federal High Court sitting in Kano State has nullified the candidature of the Abia State Governor-elect, Dr Alex Otti, and all the candidates of the Labour Party in Abia and Kano States.

The court presided over by Justice M. N. Yunusa Labour, on Friday, hinged its ruling on the party’s failure to submit its membership register to the INEC within 30 days before their primaries renders the process invalid.

The court ruled that their emergence for the 2023 elections was not in compliance with the provisions of the 2022 Electoral Act.

The Court in Suit No FHC/KN/CS/107/2023 filed by Mr Ibrahim Haruna Ibrahim against the Labour Party and the Independent National Electoral Commission, (INEC), ruled that the party did not comply with the provisions of the electoral act and cannot be said to have candidate in an election likewise cannot be declared winner of an election.

The judge described the votes credited to Alex Otti as a waste.

Reacting to this judgement, the Labour Party’s acting National Publicity Secretary, Obiora Ifoh, accused the Apapa-led faction of the Party, of conniving with enemies of democracy to destroy the party.

He added that Akingbade, the legal adviser of the Apapa faction, who presented himself as the party representative, did not oppose motion raised during court proceedings.

Ifoh went on to ask the judiciary and all law enforcement agencies, including the police and the Department of State Services, DSS, to note that Akingbade and loyalists of Apapa’s had ceased to represent the party.
